The Community Estate

For example, in Arizona, married couples have a "community estate", established on the date of the marriage. This mingling of property and assets is not terminated until dissolution or separation papers are served. Until this occurs, all marital assets are presumed to be owned equally by both parties. When the dissolution of marriage or legal separation papers are served, all earnings from that point on are considered to be owned solely by the individual who earned the benefit.
Covenant Marriage
Another concept that may be unfamiliar to clients is "covenant marriage". Under Arizona law, individuals who choose a covenant marriage may be required to prove fault in their divorce proceeding. Our attorneys of the firm are conversant with and have experience in handling the dissolution of Arizona covenant marriages. Although the concept has been part of our statutory frame work since August of 1998, most people do not engage in a covenant marriage.
